Denver Business Dispute Attorney

There is an almost endless variety of business disputes. They can involve money, licensing, property, ownership of a business or idea, employment terms, contracts and many other possible areas of disputes. None are the same, but all have the same result — stress, distraction and the possibility of loss, including property, money and the right to conduct business.

Littleton Commercial Litigation Attorney

At the law firm of Joseph A. Davies, P.C., we offer high-quality, experienced business litigation and dispute resolution legal services to clients in the Denver area, including Littleton and Aurora, as well as individuals and businesses throughout Colorado. We have resolved disputes for hundreds of parties in our more than 30 years of practice.

Our founding lawyer, Joseph Davies, and our support team can help with your dispute through negotiation, alternative dispute resolution methods such as mediation or arbitration, or business litigation and trial representation. Frequent areas of dispute are:

  • Contract disputes
  • Business ownership disputes
  • Disputes with government agencies
  • Trademarks, copyrights and other intellectual property
  • Claims of unfair competition
  • Claims of improper conduct, government investigations, professional malpractice and employment issues
  • Professional relationships and shareholder and corporate governance
  • Securities and antitrust issues
  • Technology and intellectual property, including trade secrets, patents and trademarks
  • Real estate, including boundaries, easements, liens, property titles, earnest money, leases and trespassing
  • Product liability

Common and representative cases include:

  • Two individuals went into business together. One person later wished to leave the business, and there was no agreement on how to divide the business. We negotiated an agreement that determined the partition of business interests, the value of each portion, and the departing individual's rights and responsibilities regarding disposing of his portion.
  • Two individuals went into business together, and one left the business to start a competing business. We mediated terms on the use of trade secrets, trade dress, naming rights and other conflicting claims.
  • An individual owned a campground that had discharged treated waste water across a neighboring property for 20 years. The neighbor sued to halt the discharge of waste across his property, so that he could develop the property. We brought the case to trial, where the jury determined our client had an easement allowing for continued use of the neighboring property for discharge. During the course of litigation, we also learned that the previous campground owner knew of the neighbor's intention to sue, and we also won a fraud case for our client against the previous owner.
  • Our client manufactured heating equipment, and experienced delayed shipments of parts from contracted suppliers. Our client sued for breach of contract and negligence. We arranged mediation, which preserved our client's finances and advantageous business relations.
  • Our client rented property to an individual who later claimed he was in a "rent to own" relationship with our client. We successfully protected our client's claim to his property.
